Humanitarian and compassionate applications.
Humanitarian and compassionate consideration is exceptional. It is not a regular alternative pathway to permanent residence and should not be presented as one. Where the circumstances are genuinely compelling, careful preparation matters enormously.

Who this is for
Applicants inside or outside Canada who have compelling humanitarian and compassionate factors that warrant discretionary consideration.
Decision factors
- Establishment in Canada, where applicable
- Best interests of any children directly affected
- Hardship on return to the country of origin or reference
- Health, family and other compelling factors
Evidence commonly needed
- Detailed personal statement and supporting affidavits
- Medical, psychological and country-condition reports where relevant
- Evidence of establishment, employment, community involvement and family relationships
- Independent country evidence
Process
- Case assessment with a candid read of prospects
- Preparation of comprehensive H&C submissions
- Response to further requests through processing
- Coordination with other applications where H&C is one of several routes
Risks and honest limits
H&C is not a shortcut and is not designed as an ordinary pathway. Approval is exceptional. Weak files can undermine future applications.
How an RCIC helps
We prepare H&C files where the record genuinely supports one, and we say so honestly where it does not.

A few things clients often ask.
Is H&C an appeal?
No. It is a discretionary consideration under section 25 of the Immigration and Refugee Protection Act.
Does H&C stop my removal?
No. Filing H&C does not automatically stay removal. A separate stay motion may be required.
Where removal is scheduled or possible, timing and any parallel stay motion should be planned with an RCIC or qualified Canadian immigration legal professional. Book a private consultation.
Can I file H&C from outside Canada?
Yes, though most H&C files are prepared for applicants in Canada.
